on possible confonding factor: when THC is detected in blood samples, is it the metobolites of thc or actual thc; in other words, is the thc still impairing. to my knowledge, not testong done for dui only gives the metabolites, so not an iidcator of impaimrnenty. but by now we mut have data on this? or mayn challenges to charges here.
